1. Clear understanding of labour contract terms
When entering into a labour contract, Hong Kong residents should thoroughly understand the specific terms therein, such as the duration of contract, job duties, location of workplace, occupational safety measures, etc. to protect their own interests.

2. Taking out social insurance
Hong Kong residents who work in the Mainland should, in accordance with the Social Insurance Law, Interim Regulations on the Collection and Payment of Social Insurance Premiums and relevant local regulations, participate in a social insurance scheme (including basic pension insurance, basic medical insurance, unemployment insurance, work-related injury insurance and maternity insurance) in the places where they work and pay social insurance premiums. When conditions are met, they can receive social insurance benefits in accordance with the provisions, such as the monthly basic pension insurance benefit. Hong Kong residents are required to take out social insurance under the following scenarios:

  • Hong Kong residents working in the Mainland and having an employer-employee relationship with an enterprise should, in principle, participate in basic pension, basic medical, unemployment, work-related injury and maternity insurance schemes at the location of the enterprise. Yet, for Hong Kong residents who have already taken out social insurance and maintained a social insurance relationship in Hong Kong, they may choose not to join the basic pension and unemployment insurance schemes in the Mainland by presenting supporting documents issued by the relevant institutions;
  • Hong Kong residents setting up sole proprietorship in the Mainland should pay premiums for their employees’ basic pension, basic medical, unemployment, work-related injury and maternity insurance.
Residence Permit holders not in employment may participate in the pension and medical insurance schemes for urban and rural residents.
Hong Kong residents may approach the enquiry service centre on human resources and social security in the places where they work or live for enquiries about participation in social insurance schemes.

As announced by the State Council and the Ministry of Human Resources and Social Security, with effect from 28 July 2018, Hong Kong, Macao and Taiwan residents no longer need to apply for an employment permit for working in the Mainland.

In the Guangdong Province, Hong Kong residents who meet eligible criteria may benefit from various facilitation policies on employment and entrepreneurship, such as one-off entrepreneurship grant, rental subsidy, job creation grant, interest subsidy for entrepreneurship guaranteed loan, and subsidy for hiring graduates from higher education institutions for community-level posts. Moreover, Hong Kong residents are provided with services in policy consultation, job referral, entrepreneurship advice, start-up incubation, etc.

Hong Kong residents who seek employment or work in the nine Mainland cities of the Greater Bay Area may approach the local human resources and social security department for advice by presenting their valid identity documents, such as Residence Permit for Hong Kong, Macao and Taiwan Residents, and Hong Kong and Macao Residents Entry and Exit Permit. If proof of employment status is needed, business licences, labour contracts (employment contracts), wage payment records or social insurance payment records etc. could serve as proof of employment.
